NOTICE OF PUBLIC HEARING - ORDINANCE 1538 INTERIM REGULATIONS FOR SMALL CELL WIRELESS COMMUNICATIONS FACILITIES NOTICE IS HEREBY GIVEN THAT the Lacey City Council will conduct a public hearing on February 14, 2019, beginning at 7:00 pm at Lacey City Hall, 420 College St. S.E., in the Council Chambers, for consideration of the following item:
Ordinance 1538 – Interim Regulations for Small Cell Wireless Communications Facilities was adopted by the City Council on January 10, 2019, in preparation for rollout of new FCC rules pertaining to small cell facilities. The primary objectives of the interim ordinance are to provide opportunities for wireless communication facilities consistent with the statutory rights of wireless communication service providers, preserve the existing visual and aesthetic character of the City and its neighborhoods, minimize the noise impacts generated by these facilities, address potential crowding in the ROW, and ensure the safe attachment and operation of private equipment to public infrastructure.
Amendments to the Lacey Municipal code that regulate wireless communications facilities that address small cells are summarized as follows:
Changes to Chapter 5.60
• Added definitions
• Requirement of a master license agreement with any provider requesting to place equipment in the right-of-way
• Added terms and conditions regarding emergencies, access, and shut off switches
• Substantial changes in height to existing towers will be measured from approved permits prior to January 10, 2019
Changes to 16.68
• Added definitions
• Requirement for master license agreement, site plan review, and Right of Way (ROW) permit prior to construction, installation and placement of wireless communications facilities in ROW
• Conditional use permit exemptions for minor modifications to large structures and small cells
• Application requirements
• Site development standards for attachments to buildings, wooden poles, non-wooden poles, and new poles.
• Technical and safety requirements
• A list of exempt installations
• Substantial changes in height to existing towers will be measured from approved permits prior to January 10, 2019
