9.16.010 Indecent exposure.
A. A person is guilty of indecent exposure if he intentionally makes any open and obscene exposure of his person or the person of another knowing that such conduct is likely to cause reasonable affront or alarm.
B. Indecent exposure is a misdemeanor unless such person exposes himself to a person under the age of fourteen years, in which case it is a gross misdemeanor on the first offense, and if such person has previously been convicted of violating this subsection or any similar ordinance of the city of Lacey or other city, of section 9A.88.010 Revised Code of Washington or of any sex offense as defined in Revised Code of Washington 9.94A.030, state law and the penalties prescribed therein, shall prevail. 9.16.020 Distributing obscene materials.
A. A person is guilty of distributing obscene materials if, with knowledge of the contents thereof, he sells, distributes, exhibits, displays for sale or distribution, or possesses with intent to sell or distribute any obscene material.
B. As used in this section, “obscene material” means any book, magazine, pamphlet, comic book, newspaper, writing, photograph, motion picture, film, phonograph record, tape or wire recording, picture, drawing, figure, image, design or other object which depicts:
1. Human sexual intercourse; or
2. Masturbation; or
3. Bestiality, oral or anal intercourse, or
other forms of sodomy; or
4. Direct physical stimulation of unclothed
genitals; or
5. Flagellation or torture in the context of
sexual relationships; or
6. Other patently offensive sexual activity;
provided, however, that this definition shall only include materials which,
taken as a whole, lack serious literary, artistic, political or scientific
value and appeal to the prurient interest of average persons in the community.
C. Distributing obscene materials is a gross misdemeanor. (Ord. 499 §2 (part), 1978).
9.16.030 Prostitution.
A. A person is guilty of prostitution if such person engages or agrees or offers to engage in sexual conduct with another person in return for a fee.
B. In any prosecution for prostitution, the sex of the two parties or prospective parties to the sexual conduct engaged in, contemplated or solicited is immaterial, and it is no defense that such persons were of the same sex or that the person who received, agreed to receive or solicited a fee was a male and the person who paid or agreed or offered to pay such fee was female.
C. Prostitution is a misdemeanor. (Ord. 499 §2 (part), 1978).
9.16.040 Permitting prostitution.
A. A person is guilty of permitting prostitution if, having possession or control of premises which he knows are being used for prostitution purposes, he fails without lawful excuse to make reasonable effort to halt or abate such use.
B. Permitting prostitution is a misdemeanor. (Ord. 499 §2 (part), 1978).
9.16.050 Urinating or defecating in public places.
A. It is unlawful for any person to urinate or defecate in a public place in the city which is not specifically designated and intended for that use.
B. For purposes of this section, the term “public place” means an area generally visible to public view and includes streets, sidewalks, bridges, alleys, plazas, parks, driveways, parking lots, buildings open to the public, and the doorways and entrances to buildings or dwellings and the grounds enclosing them. (Ord. 786, 1986).
9.16.060 Communication with a minor. A person who communicates with a minor for immoral purposes is guilty of a gross misdemeanor. If state law provides for a higher penalty for multiple violations that state law shall prevail.. (Ord. 1076 §8, 1998).
