ANTICIPATORY OFFENSES

9.08.010 Criminal attempt.
A. A person is guilty of an attempt to commit an offense if, with intent to commit a specific offense, under this title, or the Revised Code of Washington, such person does any act which is a substantial step toward the commission of that offense.
B. It is no defense to a prosecution for an attempt that the offense charged to have been attempted was, under the attendant circumstances, factually or legally impossible of commission.
C. An attempt to commit an offense is a misdemeanor when the crime attempted is a gross misdemeanor or misdemeanor. Attempt to commit an offense is a gross misdemeanor when the crime attempted is a class C felony under the Revised Code of Washington. (Ord. 1335 §1 2009).
9.08.020 Criminal solicitation.
A. A person is guilty of a criminal solicitation when, with intent to promote or facilitate a violation of this chapter, he offers to give or gives money or other thing of value to another to engage in specific conduct which would constitute such offense or which would establish complicity of such other person in its commission or attempted commission had such offense been attempted or committed.
B. Criminal solicitation is a misdemeanor. (Ord. 499 §2 (part), 1978).
9.08.030 Criminal conspiracy.
A. A person is guilty of a criminal conspiracy when, with intent that conduct constituting a violation of this title be performed, he agrees with one or more persons to engage in or cause the performance of such conduct, and any one of them takes a substantial step in pursuance of such agreement.
B. It shall not be a defense to criminal conspiracy that the person or persons with whom the accused is alleged to have conspired has not been prosecuted or convicted, has been convicted of a different offense, is not amenable to justice, has been acquitted or lacked the capacity to commit an offense.
C. Criminal conspiracy is a misdemeanor. (Ord. 499 §2 (part), 1978).
